Welcome to BayWa r.e. We are a leading distributor of solar energy products, including a wide range of high-quality photovoltaic (PV) systems, components, and services (“Products”) to installers across the United States. We also provide advice, information, and technical expertise on the solar industry.
This Privacy Notice describes how BayWa r.e. Solar Systems LLC (“BayWa”, “we”, “us”, and/or “our”) collects, uses and shares information about you. This notice applies to information we collect when you use our website, currently located at https://solar-distribution-us.baywa-re.com/; purchase Products from our online store, currently located at solar-store-us.baywa-re.com; engage with us through our newsletters, emails, and branded social media accounts; or otherwise interact with us (collectively, our “Services”). This Privacy Notice also describes certain legal rights you may have, subject to applicable law, and how you can exercise them.
For purposes of this Privacy Notice, “Personal Information” means information about an identified or identifiable person, as defined by applicable law. This includes information that alone or in combination with other information may be used to identify, contact, or locate you, such as your name, address, email address, or phone number.

INFORMATION WE COLLECT DIRECTLY FROM YOU
We collect information you provide directly to us in the following ways:
• When you complete a contact form or request a catalog or other product information: If you choose to fill out a contact form on our Site, we collect general identification and contact information from you, such as your name, business contact information, job title, department, name of your employer, and information related to your dealings with BayWa on behalf of yourself or your employer. We may also request your social network information (such as a LinkedIn profile) and, if applicable, the name and affiliation of the person who referred you to us.
• When you engage in direct communications with us: If you choose to communicate with us by email, telephone, SMS, physical mail, via any integrated chat services we may provide, or in person, we will collect the contents of your communication which can include any information you choose to provide. This typically includes general identification and contact details; details related to the past, existing, or potential relationship between you and us; and additional information we may request to verify your identity or conduct required screening before entering into a business relationship with you (e.g., government issued documents or information).
• When you establish an account: In order to establish an account for you, we ask you to provide your name, position in your company, company name, shipping address, billing address, telephone number, facsimile number, e-mail address; company website address; finance contact name; finance phone number; e-mail address for invoices; and e-mail address for statements. We also ask you to provide an email address and a password we can use to authenticate you at sign in. Creating an account allows you to log in on a different or shared device, purchase Products, and access your order history.
• When you make a purchase from our Site: If you choose to purchase Products through our online store, you will be required to provide certain information such as your name, payment card details, bank routing or other financial institution information, and your billing address in order to facilitate payment. Payments are handled by our third-party payment processors. You will also be asked to provide a name, phone number, and shipping address where you’d like us to send your order. We will also collect purchase, return, and exchange information in connection with your purchases.
• When you sign up for newsletter or other email communications from us: If you sign up for newsletters or email communications from us, we will collect your email address and your preferences requiring the type and frequency of communications you like to receive. We also collect any information you provide to us during the sign-up process (such as how you heard about us or which offerings you would like to learn more about).
• When you attend in-person events: If you attend conferences, trade shows, or other in-person events we host, sponsor, or organize, we will collect information from you in relation to your participation in that event. This can include records of your visit, CCTV footage, meal preferences, dietary restrictions, and other information related to your participation in the event. For individuals who require access to a BayWa office or other facility, you may be asked to provide additional information to protect the health, safety, and security of our personnel and our facilities.
• When you participate in online events: From time to time, we may offer interactive webinars, trainings, or other online events. To enable these events, we stream video and audio feeds of interactions between participants as well as the contents of any communications enabled by integrated chat functions within any third-party services that we use to provide the events. This includes collecting your image, voice, movements, physical environment, and any other information provided during the event. Occasionally, we may record events and make those recordings accessible to the general public on our sites or branded social media pages. If we do so, we will indicate that the event will be recorded.
• When you participate in a survey or otherwise provide feedback: From time to time, we may ask you to participate in a survey we are running. You are under no obligation to take part in these surveys. However, if you do agree to participate, we may collect general demographic information from you, information related to your employer and industry, and any other information relevant to that survey. If you choose to provide us with feedback in another form, we will collect the contents of your communications which can include any information you choose to provide.
• When you engage with our public relations team: We frequently communicate with journalists, media, and other public relations professionals concerning our activities or other events which are relevant or important to us. We use any information you provide to us in your capacity as a journalist or member or representative of another media outlet to inform and further our external communications efforts, including to provide you with press releases, officials statements, or other similar information.
• When you engage with us through social media platforms: If you choose to interact with us through social media on a BayWa-administered social media page, such as Facebook, Instagram, X, or LinkedIn, certain Personal Information (such as your name, your profile picture, and the fact that you are interested in BayWa) may be visible to all visitors of your personal social media page (depending on your privacy settings on the relevant social media platform) and will also be visible to BayWa. You can delete any information that you share on these platforms at any time through your relevant social medial platform’s account.
INFORMATION THAT IS COLLECTED AUTOMATICALLY
We also collect certain information automatically as you navigate or interact with our Services, including the following:
• Log information: Upon accessing our website, your browser automatically transfers specific data to our web server for technical reasons. This data includes the date and the time of the access, the URL of the referring website, the retrieved file, the data volume sent, the browser type and version, the operating system, and your IP address. This data is stored separately from other data you enter within the scope of using our website. This data cannot be assigned to a specific person; it will only be evaluated for statistical purposes or within the scope of criminal prosecutions.
• Cookies and other tracking technologies: This website uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. These cookies allow for saving certain data on your computer upon calling up our website. You may prevent the use of cookies on your computer by choosing certain selections under the settings in your browser; however, the range of functions of our internet presence may be limited by this. • Transaction Information: When you purchase or return a product, we collect information about the transaction, such as product details and the date of the purchase/return.
INFORMATION WE COLLECT FROM OTHER SOURCES
We may also obtain Personal Information from other sources. For instance, we may collect Personal Information about you from the following third-parties:
• Payment processors: In general, when you purchase Products through our Site, your payment card information is provided directly to our third-party payment processing partners, and BayWa does not collect or store that information. However, we may have access to limited information about your payment card from these partners and related transaction details, such as the last four digits of your card, the country of issuance, and the expiration date.
• Your employer: Your employer may provide us with certain information about you, including your business contact information and information relevant to your role and job duties.
• Business partners: We may collect information about you from our business partners who may provide us with your business contact information in the course of their dealings with us.
• Other sources: We may also collect information related to your responsibilities or position in an organization from publicly available sources such as trade registers, corporate websites, and other internet sites and third parties that help us update, expand, and analyze our records and inform our networking and marketing efforts. For instance, we may use information from LinkedIn or from a third-party data provider to update information about you in our contact database.
We may combine the information we collect about you from these various sources. If a combination of information that we collect identifies you as an individual, we will treat the combined information as Personal Information.
HOW IS YOUR INFORMATION USED?
We use the information described above to do the following:
• Conduct customer acquisition and outreach (including identifying and contacting prospective customers and engaging in customer communications such as newsletters and email marketing);
• Conduct standard pre-contract due diligence (including verifying identity, determining qualifications, conducting background checks, and screening owners, shareholders and directors of our customers, vendors, and business partners against publicly available and government-issued sanctions lists and media sources. For the avoidance of doubt, this screening does not involve profiling or automated decision making with respect to the screening subject);
• Provide our Services (including taking and processing your orders; shipping Products, communicating with you regarding your purchases; conducting account management and customer service functions, and sending you technical notices, updates, security alerts, and support and administrative messages);
• Operate and improve our Services (including monitoring and analyzing usage, trends, and activities related to the Services and identifying, fixing, and troubleshooting bugs and service errors);
• Communicate with you (including responding to your requests, inquiries, comments, and suggestions);
• Personalize content (including tailoring content we send or display to you in order to provide you with information and resources we think will be relevant to you);
• Further our networking, marketing, and social strategies (including posting testimonials and communicating with you by email or SMS about programs, services, offers, promotions, and events);
• Conduct data analysis (including de-identifying and/or aggregating information and using it to perform research and provide statistical information and trend data)
• Protect against, identify, investigate, and respond to misuse of our Services (including preventing and detecting fraud, unauthorized access, and other unlawful behavior);
• Support our general business operations (including maintaining our business and legal recordkeeping); and
• Carry out any other purpose described to you at the time the information was collected.
WHEN WE MAY DISCLOSE YOUR INFORMATION
We may share your information as follows:
• With companies under common control and ownership with us;
• With vendors, consultants and other service providers who need access to such information to carry out work on your behalf;
• With advertising and analytics partners;
• With your consent or at your discretion;
• When we believe disclosure is appropriate to comply with the law;
• To enforce or apply applicable terms and conditions and other agreements;
• To facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or disposal of all or part of our business or assets;

We may also share aggregate or de-identified information, which cannot reasonably be used to identify you, for various purposes including compliance with various reporting obligations; for business or marketing purposes; or to assist third parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Services.
YOUR RIGHTS AND CHOICES
You have a variety of rights and choices related to our use of your Personal Information.
• Opting out of promotional messages. From time to time, we may extend offers or other promotional communications to our business contacts. You can opt out of receiving our promotional messages at any time. You may do so by contacting us directly or by following the opt-out instructions in the promotional emails or texts we send you. Please be aware that it may take up to ten (10) days for us to process your request, and you may continue receiving promotional communications from us during that period. If you opt out of receiving such communications, please be aware that we may continue to send you non-promotional emails (such as emails related to our business relationship).
• Restricting cookies/Do Not Track. BayWa does not currently change its behavior in response to web browser “do not track” signals. However, you can configure most browsers to reject cookies or to notify you when you are sent a cookie, giving you a chance to decide whether or not to accept it. You can consult the help section of your browser to find out how to do this. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Site. In the event that a universally accepted standard emerges on how organizations should respond to “do not track” signals, we will assess and provide an appropriate response to those signals.
• Accessing, updating, or deleting your personal information. If you would like to access, update, or delete Personal Information you have provided you may do so by emailing us at ussy.privacy@baywa-re.com. Please note that we may keep certain Personal Information as necessary to comply with our legal obligations or for legitimate business purposes, such as to resolve disputes or enforce our agreements. We may also keep cached archived copies of Personal Information for a certain period of time. In the event that BayWa cannot delete your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
SECURITY OF YOUR INFORMATION
We have put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to correctly use the information we collect from and about you. These safeguards vary based on the sensitivity of the information that we collect and store. Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that your Personal information will never be disclosed, altered or destroyed in a manner that is inconsistent with this Privacy Notice.
DATA TRANSFER
Personal Information we collect may be stored and processed for the purposes set out in this Privacy Notice in the United States or in any country where we have operations or where we engage vendors or service providers. These countries may not have the same data protection laws as the country in which you originally provided the data. By using our Services or submitting your Personal Information to us, you agree to such transfers.
DATA RETENTION
We only keep your Personal Information for so long as reasonably necessary for the purposes described in this Privacy Notice, as required by law, or as necessary to resolve disputes and enforce our rights and agreements. To dispose of Personal Information, we may anonymize it, delete it, or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.
LIABILITY FOR LINKS
Our website may contain links to third-party websites, services, and applications that are not operated or controlled by BayWa. We have no influence on the contents of these websites and this Privacy Notice does not apply the privacy practices of those third parties. The respective providers or operators shall be solely responsible for the contents of the linked websites. The fact that we link to a website, service, or application is not an endorsement, authorization, or representation of our affiliation with that third party. We encourage you to review the privacy practices of any third-party service before providing any Personal Information to or through them.
CHILDREN’S PRIVACY
Our Services are intended for adults and we do not knowingly collect Personal Information from children.
